Signature Trips Booking Terms & Conditions
SCOPE OF APPLICATION
These Terms & Conditions apply exclusively to JT Travel Design Signature Trips offered for booking on the JT Travel Design website.
They do not apply to Individual Travel Design services, corporate travel and events, privately organized group travel, retreats, or other custom-designed programs and services.
The terms applicable to such services, including payment schedules, cancellation conditions, and other contractual arrangements, will be specified separately for each engagement, proposal, or program and may vary depending on the nature of the services and the terms imposed by third-party suppliers.
1. BOOKING REQUESTS AND BOOKING CONFIRMATION
Submission of a Booking Request does not reserve or guarantee a place on a program.
After receiving a Booking Request, JT Travel Design will review availability and may contact the participant regarding the program, payment arrangements, or other booking details.
A place on a program is reserved only after JT Travel Design has received the required deposit and issued a Booking Confirmation to the participant.
The Booking Confirmation, the applicable program description, the booking details provided to the participant, and these Terms & Conditions form part of the agreement between JT Travel Design and the participant.
The number of places available on each program is limited and specified in the program description.
2. PRICE AND PAYMENT
The total program price, required deposit, payment schedule, and deadline for final payment are specified in the applicable program description and/or the booking information provided to the participant.
Unless otherwise expressly stated in writing, the price confirmed by JT Travel Design at the time of booking will not be increased after the Booking Confirmation has been issued.
The remaining balance must be paid no later than 21 days before the program start date, unless a different payment deadline is expressly stated in the applicable program description or booking information provided to the participant.
If the remaining balance is not received by the payment deadline, JT Travel Design may notify the participant of the overdue payment and provide an additional period of three calendar days to complete payment.
If payment is not received within that additional period, and no written extension has been agreed by JT Travel Design, JT Travel Design may cancel the booking, apply any cancellation fee permitted under these Terms & Conditions and applicable law, and offer the place to another participant.
Any written extension of a payment deadline is granted at the discretion of JT Travel Design and does not amend the payment terms applicable to other bookings.
3. FLIGHTS AND TRAVEL TO THE PROGRAM
Unless otherwise stated in the program description, flights are not included in the program price and must be arranged independently by participants.
Once a participant's place on the program has been confirmed, JT Travel Design will provide recommendations for suitable flight options based on the program schedule, arrival and departure times, location, and overall travel logistics.
Participants are strongly advised not to purchase non-refundable flights or other non-refundable travel arrangements until their place on the program has been confirmed by JT Travel Design.
The final selection and purchase of flights remain the participant's responsibility.
Participants are responsible for meeting airline requirements, ensuring they hold all necessary travel documents, and covering costs arising from flight delays, schedule changes, cancellations, missed connections, or other airline-related matters, except where applicable law provides otherwise.
4. PROGRAM CHANGES BEFORE DEPARTURE
JT Travel Design may make minor changes to the itinerary, sequence of activities, restaurants, wineries, accommodation, transport arrangements, guides, and other program elements where operational circumstances make such changes necessary.
JT Travel Design will make reasonable efforts to preserve the overall character, standard, and quality of the program.
Participants will be informed of material changes in accordance with applicable law.
If, before the start of the program, JT Travel Design is required to make a significant change to an essential element of the booking, the participant will be informed on a durable medium and will be provided with the options and rights required by applicable law, which may include accepting the proposed change, accepting a substitute program where offered, or terminating the agreement without a cancellation fee and receiving the applicable refund.
5. CANCELLATION OF THE PROGRAM BY JT TRAVEL DESIGN
JT Travel Design may cancel a program where the minimum number of participants required for the program has not been reached, provided that the applicable minimum number is stated in the program description or booking information and the participant is notified within the time limits required by applicable law.
Unless a shorter period is permitted by applicable law, cancellation due to insufficient participant numbers will be communicated no later than:
- 20 days before the start of a program lasting more than six days;
- 7 days before the start of a program lasting between two and six days;
- 48 hours before the start of a program lasting less than two days.
JT Travel Design may also terminate the agreement before the start of the program where unavoidable and extraordinary circumstances prevent JT Travel Design from performing the agreement, subject to the requirements of applicable law.
Where JT Travel Design cancels the program in accordance with applicable law, the participant may choose, where offered by JT Travel Design, to transfer amounts paid to another JT Travel Design program or receive a refund of all amounts paid directly to JT Travel Design.
Any refund required by applicable law will be made within the legally applicable period.
JT Travel Design is not responsible for additional expenses incurred independently by participants outside the program, including flights, insurance, visa fees, or accommodation booked before or after the program, except where applicable law provides otherwise.
6. CANCELLATION BY THE PARTICIPANT
A participant may cancel their booking at any time before the start of the program by notifying JT Travel Design in writing.
Subject to the participant's mandatory rights under applicable law, the following standard cancellation fees apply:
- 35 days or more before the program start date – a full refund of all amounts paid;
- 34 to 15 days before the program start date – the deposit paid to confirm the booking will be retained as the applicable cancellation fee;
- less than 15 days before the program start date – the program price paid by the participant will not be refunded, subject to applicable law.
If requested by the participant, JT Travel Design will provide an explanation of the amount of the cancellation fee in accordance with applicable law.
If the vacated place is successfully filled by another participant, JT Travel Design may reduce the cancellation fee and issue an additional partial or full refund, taking into account the costs saved, income received from reallocating the travel services, and any reasonable administrative costs or losses incurred.
Nothing in this section limits any right the participant may have under applicable law to terminate the agreement without paying a cancellation fee where unavoidable and extraordinary circumstances occurring at the destination or its immediate vicinity significantly affect the performance of the program or the transport of passengers to the destination.
In such circumstances, the participant will be entitled to the refund required by applicable law but will not be entitled to additional compensation solely as a result of the termination.
7. TRANSFER OF THE BOOKING TO ANOTHER PARTICIPANT
A participant may transfer their booking to another person who satisfies all conditions applicable to the program, subject to the requirements of applicable law.
The participant must notify JT Travel Design on a durable medium within a reasonable period before the start of the program. Notice provided no later than seven days before the start of the program will be considered reasonable, without prejudice to any rights provided by applicable law.
The transferring participant and the person receiving the booking may be jointly responsible for any outstanding balance and for actual and reasonable additional costs arising from the transfer, in accordance with applicable law.
JT Travel Design will provide evidence of such additional costs upon request where required by applicable law.
8. TRAVEL INSURANCE
Participants are strongly advised to obtain appropriate travel insurance for the full duration of their trip.
Depending on the participant's circumstances, appropriate coverage may include emergency medical expenses, trip cancellation or interruption, personal belongings, and repatriation.
The participant is responsible for reviewing the terms, exclusions, and coverage limits of their insurance policy.
The purchase or non-purchase of travel insurance does not limit the rights of participants or the obligations of JT Travel Design under applicable law.
9. PARTICIPANT RESPONSIBILITIES
Participants are responsible for providing complete and accurate information required for their booking and for informing JT Travel Design promptly of any changes.
Participants are responsible for holding valid passports, visas, residence documents, health documentation, and any other documents required for travel and participation in the program.
Participants must comply with the laws and regulations of the destination, accommodation rules, transport requirements, and reasonable instructions relating to the safe and proper operation of the program.
Participants should inform JT Travel Design before booking of any mobility, accessibility, dietary, or other requirements that may affect their participation in the program or require specific arrangements.
During the program, participants must inform JT Travel Design without undue delay of any lack of conformity or problem with the travel services included in the program, taking into account the circumstances of the case, so that JT Travel Design has a reasonable opportunity to address the issue.
Any damage caused by a participant to property belonging to JT Travel Design, service providers, accommodation providers, other participants, or third parties may be charged to the participant responsible, subject to applicable law.
10. RESPONSIBILITY FOR THE PERFORMANCE OF THE PROGRAM
JT Travel Design is responsible for the proper performance of the travel services included in the agreement in accordance with applicable law, regardless of whether those services are performed directly by JT Travel Design or by third-party service providers.
If any travel service included in the program is not performed in conformity with the agreement, JT Travel Design will address the lack of conformity in accordance with applicable law.
Where applicable, participants may be entitled to an appropriate price reduction, compensation, alternative arrangements, or other remedies provided by law.
Nothing in these Terms & Conditions excludes or limits any liability of JT Travel Design where such exclusion or limitation is prohibited by applicable law.
11. UNAVOIDABLE AND EXTRAORDINARY CIRCUMSTANCES
The rights and obligations of JT Travel Design and participants in the event of unavoidable and extraordinary circumstances will be governed by applicable law.
Depending on the circumstances, this may include changes to the program, termination of the agreement, refunds, alternative arrangements, assistance to participants, or other rights and obligations required by law.
JT Travel Design will not be liable to pay compensation where applicable law excludes such liability because a lack of conformity or failure to perform results from unavoidable and extraordinary circumstances.
Nothing in this section limits any mandatory right of a participant under applicable law.
12. ASSISTANCE TO PARTICIPANTS
JT Travel Design will provide appropriate assistance without undue delay to a participant who experiences difficulty during the program, as required by applicable law.
Such assistance may include providing appropriate information regarding health services, local authorities, consular assistance, or communications, and helping the participant find alternative travel arrangements where reasonably possible.
JT Travel Design may charge a reasonable fee for such assistance where the difficulty was caused intentionally by the participant or through the participant's negligence, to the extent permitted by applicable law.
13. PROGRAM FORMAT AND PARTICIPATION
JT Travel Design Signature Trips are designed for small groups and follow a pre-arranged itinerary.
Program elements may include walking, transfers between locations, group meals, scheduled activities, and participation in group experiences.
Participants are responsible for considering the physical and practical requirements described in the program information before booking and for informing JT Travel Design of any relevant accessibility or participation requirements.
JT Travel Design will consider reasonable requests and provide information about the suitability of a program where requested, but participation may be subject to practical, safety, or operational limitations.
14. COMPLAINTS AND CONTACT
Participants should notify JT Travel Design as soon as reasonably possible of any issue arising during the program so that JT Travel Design has an opportunity to address it.
Formal complaints may be submitted to JT Travel Design using the contact details provided on the website.
Information about applicable consumer dispute resolution mechanisms is available through the Legal Notice on the JT Travel Design website.
15. APPLICABLE LAW AND MANDATORY CONSUMER RIGHTS
These Terms & Conditions and agreements for JT Travel Design Signature Trips are governed by Portuguese law, without prejudice to any mandatory consumer protection rights that may apply under the law of the participant's country of habitual residence or other applicable law.
Nothing in these Terms & Conditions excludes, restricts, or waives any mandatory rights granted to participants under applicable consumer protection or package travel legislation.
